0.5 Headings

Section headings are provided solely for reference and convenience. They shall not limit, modify, or otherwise influence the interpretation of any provision contained in these Terms.

1. General Information

AlzReady sells printed caregiver journals and other physical goods intended to support families caring for individuals with Alzheimer’s or other dementias. These Terms describe the conditions under which purchases are made and outline the respective responsibilities of both the Buyer and the Seller.

2. Product Information and Use

We make reasonable efforts to describe our Products accurately. Actual colors, layout, or design details may vary slightly due to printing or screen variations.

All Products and Content are provided for personal, non-professional, informational use only. They are not intended to provide medical, legal, financial, therapeutic, or other professional advice.

3. Medical and Informational Disclaimer

The Content contained in our Products and on our Website is for general informational purposes only.

  • We do not provide medical advice.
  • Our authors are not doctors, nurses, or licensed medical professionals.
  • Nothing we publish or sell is intended to diagnose, treat, prevent, or cure any disease, condition, or medical issue.
  • No specific outcome or result is guaranteed.

While we gather information from reputable sources, we do not guarantee completeness, accuracy, or timeliness and are not responsible for errors or omissions in reporting or explanation.

Buyers should verify all important information with additional trusted sources.

You must not use our Content for self-diagnosis or to replace professional medical consultation. Always seek the guidance of a qualified physician or licensed healthcare provider for any medical questions or decisions.

Purchasing a Product from us does not establish a medical, advisory, therapeutic, or other professional relationship.

4. Ordering and Payment

All prices are listed in U.S. dollars.

You agree to provide complete and accurate billing and shipping information at checkout. You authorize us to charge your selected payment method at the time of purchase.

Applicable sales tax will be applied where required by law.

We reserve the right to decline or cancel any Order at our discretion, including but not limited to cases of suspected fraud or errors in pricing or availability.

5. Shipping and Delivery

Orders will be shipped to the address provided at checkout. You are solely responsible for ensuring that the shipping address is correct, complete, and current. We are not responsible for delays, losses, or failed deliveries resulting from inaccurate or incomplete address information provided by the Buyer.

Processing and delivery timelines are estimates only. Shipping carriers may experience delays beyond our control.

The risk of loss transfers to the Buyer once the Order is handed to the shipping carrier.

If an Order is returned to us due to an incorrect or undeliverable address, the Buyer will be responsible for additional postage costs to re-ship the Order.

6. Returns, Refunds, and Exchanges

All sales are final. We do not accept returns or exchanges.

Due to the fragile nature of printed books and the requirement that returned items be in pristine condition for resale, we cannot accept returns for any reason other than verified printing defects.

If your Product arrives with a printing defect, you must notify us within 7 days of delivery and provide clear photographic evidence. Upon verification, we will issue a replacement copy at no additional cost.

We cannot replace items damaged due to:

  • Shipping carrier mishandling
  • Improper handling by the Buyer
  • Bending, creasing, moisture, or accidental damage
  • Buyer preference, remorse, or subjective dissatisfaction

If your Order was damaged by the carrier, you may file a claim directly with the shipping provider.

7. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for indirect, incidental, special, punitive, or consequential damages of any kind.
  • You assume all responsibility for your use or interpretation of the Content.
  • We are not responsible for decisions you make as a result of reading or relying upon our Content or Products.

If you have any concern involving safety, health, or medical care, you must consult a qualified healthcare professional.

8. No Professional Relationship

Purchasing a Product from us does not create a doctor–patient relationship, caregiver coaching relationship, consultancy, fiduciary duty, or any other professional relationship.

9. Intellectual Property

All Content, designs, layouts, graphics, and materials provided through the Website or included in our Products are the exclusive property of AlzReady and are protected by copyright, trademark, and other intellectual property laws.

You may use our materials solely for your own personal, non-commercial use. You may not reproduce, distribute, sell, modify, publish, or share our Content without our express written consent.

10. Customer Responsibilities

By completing a purchase, you agree to:

  • Use our Products in a lawful and appropriate manner.
  • Seek qualified medical assistance when necessary.
  • Avoid misusing, misinterpreting, or over-relying on informational Content.
  • Provide accurate information during the checkout process.

11. Privacy

Personal information collected during checkout is used to process, deliver, and support your Order. Additional details regarding data collection, storage, and use can be found in our Privacy Policy.

12. Governing Law

These Terms and any disputes arising from your purchase shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any legal proceedings must be initiated in the state or federal courts located in California.

13. Confidentiality

Any non-public information disclosed by AlzReady to the Buyer in connection with a purchase—including internal communications, fulfillment processes, or pricing details—shall be treated as confidential. The Buyer may not disclose or distribute such information without our prior written consent, except where required by law.

This confidentiality obligation does not apply to information that:

(a) becomes publicly available through no fault of the Buyer;

(b) is independently obtained without breach of these Terms;

(c) must be disclosed pursuant to legal process.

14. Arbitration Agreement

Mandatory Binding Arbitration.

Any dispute, claim, or controversy arising out of or relating to your purchase, these Terms, or the use of the Website shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.

Mutual Agreement.

Both the Buyer and AlzReady agree to resolve disputes through arbitration rather than through court litigation. Both parties waive the right to a trial by jury.

Individual Claims Only.

Arbitration shall be conducted on an individual basis. Class actions, class arbitrations, representative claims, and collective proceedings are not permitted.

Exceptions.

Either party may bring an individual action in small claims court if eligible.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain valid, binding, and enforceable.

16. Updates to These Terms

We may modify or update these Terms at any time. The effective date at the top of this page reflects the most recent version. Continued purchases following the posting of revised Terms constitute acceptance of the updated conditions.
